The Egyptian parliament ended the seventh month of the first session in the current legislative term by approving a different set of laws that were issued, and the committees are still discussing a number of other laws of interest to citizens, and on the other hand, the representatives continued to perform their oversight role through parliamentary mechanisms such as briefing requests, questions and urgent statements And the proposal for an interrogation, but despite the passage of seven months after the parliament convened, none of the ministers has been questioned, although there are many cases and many requests made by the deputies to the Presidency of the Council, which has not yet been decided upon.

In a different context, the differences between the Speaker and the Representatives continue to escalate as a result of the Speaker boycotting and directing the Deputies, which aroused the Parliament’s anger from the actions of the Speaker.

The period covered by the report witnessed the registration of a new record for the number of female representatives within the Council, which reached 90, after Representative Abeer Al-Khouli swore the constitutional oath for the Fayoum governorate after the seat was vacant due to the death of the Fayoum deputy.

This seventh report comes as part of a follow-up Maat for Peace, Development and Human Association Parliamentary performance by monitoring and analysis within the framework of the institution’s keenness to build a real legislative institution that can work to realize the dreams of the Egyptian people. The report covers the period from July 11, 2016 to August 10, 2016.

This report is based on an aggregate of what has been published on news websites specialized in parliamentary affairs, as well as the statements and meetings of the MPs, television and press, and their personal pages on social networking sites, as well as what is broadcast on the Egyptian Voice of the People channel.

The report focused on monitoring the legislations approved or discussed by parliament during the period it covers, and the report also monitors the oversight role of parliament on the performance of the state’s executive bodies and the relationship between parliamentarians and executive bodies. The report also displays foreign visits to the parliament and also the parliament’s reception of diplomats from other countries at the official level.

First: The legislative performance of Parliament:

The Council issued this month a set of laws, the most important of which were: -

  • Parliament approved Law No. 199 of 2014 amending some provisions of the Police Authority Law promulgated by Law No. 109 of 1971, in addition to the President of the Republic's decision, Law No. 130 of 2014, amending some provisions of the Police Authority Law, promulgated by Law No. 109 of 1971. The additional fee, which is collected on some of the services provided, in light of the increasing financial burdens borne by the Fund for the Improvement of Social and Health Care Services.
  • The Council approved the decision by Law No. 118 of 2015 amending some provisions of the application of the provisions of Chapter V of Law No. 14 of 2014 to workers in university hospitals, medical departments, and university student hospitals, and approved the decision by law of 341 deputies, 11 members rejected it, and 7 members abstained.
  • The Egyptian Parliament approved the report of the joint committee from the Constitutional and Legislative Affairs Committee and the Bureau of the Council's Economic Affairs Committee regarding the draft law submitted by the government to amend some provisions of the Central Bank, Banking and Monetary System Law promulgated by Law No. 88 of 2003. The amendment included imprisonment for a period of no Less than three years and not more than ten years, and a fine of not less than one million pounds and not exceeding five million pounds, or the financial amount involved in the crime, whichever is greater, for anyone who violates the provisions of Article 111 of this Law or Article 114 and the decisions issued in implementation thereof.
  • The House of Representatives approved a bill amending Law No. 35 of 1967 regarding trade unions. And that is after the parliament failed more than once in adopting the bill during several sessions because of the lack of a quorum.
  • The House of Representatives approved the report of the Legislative and Constitutional Affairs Committee on a draft law submitted by the government to amend the State Council’s law, once and for all, after deleting the fifth article from the draft submitted by the government, which relates to imposing fees on cases that are before the State Council. The committee stated that its deletion of the article To relieve litigants and not to burden them with any additional burdens due to the economic conditions that the country is going through.
  • The House of Representatives approved the extension of the law on the participation of the armed forces in protecting and securing vital and public installations, for the next 5 years. The government had submitted a project to extend the law for a period of two years, but the Defense and National Security Committee considered that the current situation in the country needs a longer period, so it stood unanimously, provided that the period is 5 years.
  • The House of Representatives approved the new civil service law, in principle, and approved the bill in a group after completing the discussion and approval of each article separately. Parliament sent the draft law to the State Council to review it and adjust its wording while taking the opinion of the judicial bodies in the articles related to it, including the Administrative Prosecution Authority regarding Article 59. The Council re-discussed Article 38 after deliberating on it in the Manpower Committee, and approved what the committee concluded by amending the article , Which provided for the employee to be granted an incentive bonus 5% from the job wage, after it was 2.5% in the government project.
  • Parliament approved the President of the Republic's decision on a bill amending some provisions of Law No. 143 of 1994 regarding civil status. The amendments included amending the text of the fourth paragraph of Article 8 by increasing the maximum fee for requesting copies of records
  • The Plan and Budget Committee continues to convene to discuss the added tax law in the presence of the Minister of Finance and the Deputy Minister for Tax Policies, the Head of the Tax Authority and a number of the Ministry’s leaders and the Finance Minister’s advisers in discussing the articles of the draft law, as it completed the articles of issuance, and proceeded to discuss the articles of the draft law.
  • The Council finally approved a draft law on increasing pensions and amending some provisions of the Social Insurance Law promulgated by Law No. 79 of 1975 and the Comprehensive Social Insurance System Law promulgated by Law No. 112 of 1980 after having the majority required for that.
  • The Council approved, by a majority of 414 members, Presidential Decree No. (319) for the year 2016 to extend the state of emergency in some border areas in North Sinai Governorate, and the Council recommended to activate the recommendations of the General Committee to reduce the burden on the people of Sinai.

In the same context, Parliament agreed to refer a set of international agreements to the relevant committees in preparation for approval, which included:

The House of Representatives agreed to refer the agreement signed between the governments of Egypt and Germany in Cairo on March 24, 2016, regarding technical cooperation for the year 2012, to the Economic Affairs Committee and the Office of the Foreign Affairs, Plan and Budget Committee.

  • Parliament agreed to refer the agreement signed in Cairo on March 24, 2016 between the governments of Egypt and Germany on financial cooperation “Education Quality Support Program - Phase Two,” issued by Presidential Decree No. 293 of 2016, to a joint committee of the Education and Scientific Research Committee and the offices of the two committees Foreign Affairs, Plan and Budget.
  • He also agreed to refer a second loan agreement to finance the South Helwan power generation plant project and to amend the first loan agreement signed on March 18, 2012 between the government of Egypt and the Kuwaiti Fund for Arab Economic Development signed in Cairo on March 15, 2016 issued by Presidential Decree No. 294 of 2016, to a committee Joint of the Committee on Energy and Environment and the Bureau of Economic Affairs Committee.
  • The Council agreed to refer the simplified agreement regarding the implementation of a regional arbitration center in the Delta between the government of Egypt and the French Development Agency, which was signed in Cairo on April 17, 2016, issued by Presidential Decree No. 297 of 2016, to the Energy and Environment Committee and the Office of the Economic Affairs Committee.
  • The Council referred the agreement on cooperation in the field of peaceful uses of nuclear energy between the governments of Egypt and the Kingdom of Saudi Arabia, signed in Cairo on April 8, 2016, issued by Presidential Decree No. 298 of 2016, to a joint committee of energy and the environment and the office of the Arab Affairs Committee.
  • The Council also referred the Air Services Agreement signed in Athens on December 8, 2015 between the governments of Egypt and Greece, in which Presidential Decree No. 299 of 2016 was issued, to the Tourism and Civil Aviation Committee and the offices of the Plan and Budget and Defense and National Security Committees,
  • Parliament referred the agreement to implement a grant regarding the project of delivering natural gas to homes, signed in Cairo on April 17, 2016, between the government of Egypt and the French Development Agency, in which Presidential Decree No. 308 of 2016 was issued, to the Energy and Environment Committee and the offices of the Economic Affairs, Energy and Environment Committees.
  • Parliament referred Amendment Annex No. 1 to the Memorandum of Understanding between the Government of Egypt and the European Union regarding the Unified Support Framework 2014-2015 signed in Cairo on April 21, 2016 and issued by the Presidential Decree No. 314 of 2016, to the Economic Affairs Committee.
  • Parliament referred Presidential Decision No. 344 of 2014 regarding the agreement signed in Cairo between the governments of Egypt and Bahrain, to prevent double taxation and evasion, to the Legislative Committee.

The House of Representatives Industry Committee approved Presidential Decision No. 229 of 2016 regarding the framework agreement between the Ministry of Industry, Trade and Small and Medium Enterprises, the Ministry of Investment, the National Development and Reform Commission and the Ministry of Commerce of the People's Republic of China, and that agreement was signed in Beijing on September 2, 2015.

  • The Plan and Budget Committee approved an agreement to avoid double taxation and prevent tax evasion with regard to income taxes between Egypt and Saudi Arabia. The agreement aims to create a good environment for investment and avoid double taxation for the investor.
  • The House of Representatives approved a cooperation agreement between Egypt and Saudi Arabia regarding maritime transport, whereby the Transport and Communications Committee, in conjunction with the Defense and National Security Authority, approved a cooperation agreement in the field of maritime transport and ports between the governments of Egypt and Saudi Arabia signed in Cairo on April 8.

The House of Representatives also approved the mandate of the President of the Republic to break the session according to the text of Article 115, Paragraph (2) of the Constitution.

Second: The oversight role of Parliament

During the period covered by the report from July 11 to August 10, the House of Representatives witnessed the committees discussing a number of briefing requests, while a large number of representatives used their parliamentary tools to submit briefing requests, questions, urgent statements and interrogation requests to the government, including: -

  • The Council considered (112) briefing requests and (13) questions directed to each of the Prime Minister, the Minister of Housing, Utilities and Urban Communities, the Minister of Local Development, and the Minister of Planning about drinking water and sanitation problems as a result of the deterioration of networks, the failure to replace and renew the stations and the failure to build new networks in Some urban areas.
  • The fact-finding committee meets continuously to study wheat problems, and the fact-finding committee requested that it be met with the specifications and standards of the places in which storage is carried out, so that the legal responsibility and violations related to storage can be determined. The fact-finding committee also requested a committee from the Ministry of Supply to examine the violations and take legal action against the violators Protection of public funds.
  • MP Mohamed Badrawi, head of the parliamentary bloc of the Egyptian National Movement Party and the representative of the Industry Committee in the House of Representatives, submitted a request for an interrogation and withdrawal of confidence from the Prime Minister, Eng. Sherif Ismail, the Ministers of the Economic Group, the Ministers of Health, Supply and Internal Trade and the Minister of Education and demanded that the interrogation be included in the Council's agenda as soon as possible. And that this is a violation of the principle of equal opportunities, intentionally discriminating against women by the State Council, and contrary to explicit provisions in the 2014 Constitution, such as articles (9, 11, 14, and 53) which stipulate non-discrimination and that public jobs are a right for citizens on the basis of competence and not gender.
  • Attorney Alaa Wali applied for a briefing and referred the defendants to the Public Prosecution regarding the financial and administrative confusion at the Ministry of Housing, Utilities and Urban Communities for undertaking the process of allocating 10 plots of land with an area of 10 acres to a Saudi female client, and the similarities of this process of duplication in selling and fraud and fraud has reached the allocation of that land for a period of 5 years. About selling at a lower price than the usual, which was about 1000 pounds per meter, while the meter was estimated at 6,200 at the time, and this means a waste of public money.
  • MP Mustafa Bakry, a member of the fact-finding committee formed in Parliament regarding wheat corruption, submitted an interrogation directed against the Minister of Supply Khaled Hanafi about the randomness of decisions in the ministry, mismanagement and waste of public money, demanding during the interrogation to withdraw confidence from the Minister of Supply because he issues decisions that enable the Ministry's employees to seize public money.
  • Mohamed Fouad, a member of Parliament for the Wafd Party, submitted a request for a briefing to Eng. Sherif Ismail, Prime Minister, on the committee for developing high school exams and confronting the phenomenon of electronic cheating, which was formed by a decision of the Prime Minister and chaired by the Minister of Education
  • MP Afifi Kamal submitted a request for a briefing directed to the Minister of Industry due to the stoppage of many factories, and others worked at half their capacity despite the factories possessing the components of industry.
  • Two representatives of the Nour Party submitted an urgent statement to the Minister of Supply for the delay in issuing the ration cards. The two representatives explained that the Ministry of Supply had contracted with the two companies "Avit" and "Smart" to extract the supply cards, but notes that the issuance of the cards is delayed for a long period of time, as well as extracting a replacement for these cards. It is delayed for several months, and sometimes up to years, and that the delay in issuing the cards leads to the citizens missing the opportunity to benefit from their ration, as well as the points difference, indicating that they submitted requests to the Minister of Supply regarding this matter for a period of more than two months and no response was made.
  • MP Khaled Hanafy presented an urgent statement addressed to the Prime Minister regarding some of the problems that persons with disabilities face when they deal with government agencies, such as their departure from all over the Republic to the Medical Council Administration in Nasr City to sign a medical examination on them to obtain their right to buy cars equipped for them, and he asked “Why The government tortures this group
  • Representative Khaled Hilali, a member of Parliament, submitted a request for information to the Minister of Transport regarding “Al-Hamoul-Riyadh” and “Riyadh-Pump” roads and the sugar-beet factory in Kafr El-Sheikh, which is called the road of death, demanding the road repair
  • Deputy Muhammad al-Husseini submitted a request for a briefing addressed to the Prime Minister, Minister of Agriculture and Minister of Endowments on the stolen state of state land, as MP Muhammad al-Husseini, representative of the Wafd Party, believes that state lands and properties are being looted over decades due to several people, which cost Egypt billions of pounds, including, for example, reclaimed agricultural lands Bulaq Dakrur.
  • Bakri demanded that the Prime Minister attend Parliament to respond to the danger of granting Egyptian nationality to foreigners, in exchange for money deposited in Egyptian banks, without taking into account the risk of granting the nationality to the national security of the country, or events of instability in some areas as a result of the possibility of expansion in these decisions. Third: Parliament's relationship with the executive and the provision of services

Salama Al-Gohary met with a member of Parliament and Minister of Endowments, Dr. Muhammad Mukhtar Jumaa, to discuss a number of requests for the people of Zefta Department, and to present the department's problems with regard to the endowment sector.

  • Ibrahim Nazeer, a member of Parliament, said that he contacted the Ministry of Housing to solve the citizens' crisis due to the low voltage of the electrical supply from the Qusiya transformer station.

  • MP Mahmoud Mohamed Zayed, Member of Parliament, submitted a request to Dr. Mukhtar Jumaa, Minister of Endowments, regarding the inclusion of the Bilal bin Rabah Mosque in the village of Mit Habib to the Ministry of Endowments, which was built with the special efforts of the people of the village of Mit Habib.

Fourth: Parliament's foreign relations

Ali Abdel-Aal, Speaker of the House of Representatives, at the parliament’s headquarters, in the presence of the two agents, inaugurated the first meeting of the Parliamentary Friendship Association between Egypt and Britain, which is chaired on the Egyptian side by Representative Dalia Youssef.   • Speaker of the House of Representatives, “Masahisa Sato,” received the Chairman of the Foreign Affairs and Defense Committee of the Japanese Parliament and his accompanying delegation, in the framework of supporting and consolidating bilateral relations between the two countries and strengthening cooperation, especially in the parliamentary field.
  • The Deputy Secretary-General of the Council received a delegation of the Pan-African Parliament headed by the Secretary-General of Parliament and a number of the General Secretariat staff to discuss arrangements for Egypt to host the regular session of the Pan-African Parliament during the month of October.
  • Representatives of the House of Representatives received (87) young sons of Egyptians in France, who arrived in the company of Ambassador Nabilah Makram, Minister of Immigration and Egyptians abroad, and emphasized the role of youth as ambassadors for Egypt abroad to clarify the image of Egypt and reflect its reality, and the reality of its resistance to the wave of terrorism sweeping the world.
  • The representatives of the Egyptian Parliament, Mr. Sherif, Suleiman, Wahdan, and the deputies, Sahar Sedqi, Kamal Amer and Saad Al-Gammal will meet.   • The House of Representatives received a delegation of Palestinian youth hosted by the Ministry of Youth and Sports at the invitation of Major General Saad Al-Gammal, Chairman of the Arab Affairs Committee, in the presence of the Secretary-General of the House of Representatives and the Deputy Secretary-General, Ambassador Fahmy Fayed, Secretary General of the Arab Parliament, Ambassador Abdel Moneim Saoudi, Senior Advisor to the Arab Affairs Committee, and Dr. Jihad Amer, Member of Parliament and Mrs. Mahera El-Gamal, coordinator of the Palestinian delegation, and the meeting comes within the framework of the permanent council’s keenness on continuous parliamentary communication and interaction with Arab youth and sister countries.
  • Deputy Secretary General of Parliament Khaled Al-Lawzi - Secretary-General of the Jordanian Senate, received at the Egyptian House of Representatives within the framework of coordination and cooperation between the Egyptian parliament and its Jordanian counterpart at all levels of parliamentary work.
  • Mr. Silman Wahdan, Deputy Secretary of the Council, participated in the activities of the Iranian opposition conference held in Paris. The conference was attended by (54) countries, including the United States, Britain, France, and many European and Arab countries, including Egypt, Algeria, Saudi Arabia, Jordan and Palestine.
  • Ali Abdel-Al received in his office in the House of Representatives the Foreign Minister of Cyprus and the accompanying delegation. Abdel-Al praised the growth of bilateral relations with Cyprus in various fields and the Cypriot role in support of Egypt in the framework of relations between Egypt and the European Union and stressed the importance of strengthening cooperation between the two countries in the field of energy and studying ways to maximize mutual benefit from New oil discoveries to achieve the interests of the two countries

  • Representative May Al-Batran, head of the Communications Committee of the House of Representatives, insisted on removing the parliamentary editors from the hearing session held by the committee for representatives of the telecommunications sector in Egypt on the draft value-added bill. The deputy considered that what the journalists heard was enough and they had to go out so that parliamentarians could take a rest in the debate, but the Minister of Finance objected The deputy’s response was that this was the wish of the members.
  • Haytham Hariri demanded the cancellation of the holidays until the end of the session of the current September 30th due to the end of the discussion of complementary laws. Hariri pointed out that although there is no penal text for Parliament if it is unable to issue laws complementing the constitution in the first session, he must abide by the constitution and be diligent in discussing these Legislation to be completed on time in advance.

Sixth: final conclusions

Despite the passage of seven months since the parliament convened and the issuance of many legislations, the parliament still has not issued the legislation stipulated in the Egyptian constitution approved in the year 2014, as it specified in Chapter Six of it "General and Transitional Provisions", the laws that Parliament must complete during the session First, for example, Article (235) of it stipulates that “the House of Representatives in its first session after the implementation of this constitution shall issue a law to regulate the construction and restoration of churches in a manner that guarantees the freedom of Christians to practice their religious rites.”

Article (241) also stipulated that “The House of Representatives shall, in its first session after the entry into force of this constitution, issue a transitional justice law that guarantees the truth, accountability, proposes frameworks for national reconciliation, and compensation for victims, in accordance with international standards.” Article (242), which stipulates the preparation of an integrated law for local administration, is in addition to a number of laws that are called as complementary to the constitution and which require their speedy issuance, including the laws of the National Elections Authority and the Elections Law, which define the form of the next parliament, the law of the judicial authority and others.

  • Parliament still relies on receiving projects and legislations, especially economic ones, from the government and approves them. It has not yet touched upon the stage of asking the government for more legislation or initiating the presentation of those legislation that the state needs. For example, many parties and civil society institutions have submitted draft laws for local administration and the committee has not discussed There are only three projects, and they always announce that the reason for the delay in issuing the law is that the government has not submitted a law.
