Declaration About The Efficiencies of The Training Course "For Practicing The Legal Procedures Concerning The Detainees' Issues"

Maat Center for Judicial and Constitutional Studies held, in ElManar hotel in El-Mohandseen –Cairo ,a training course tackled "Training on the Legal Procedures Concerning the Detainees' Issues ". This course extended from 22 until 24 of June 2006 and it was attended by thirty lawyers from Playroom and Alexandria governorates . The First Day
The activities of the first day started at 4 am.

During the first day the Manager of the center delivered an inaugurating speech that tackled "The Emergency Law and its effect on General Freedom since its declaration after the platform event in 1981 and the competences authorized to the President under the provisions of this law .Some of the repercussions of this law are the series of repeated detentions and the inconsistent declarations of the Minister of Interior concerning the detainees inside the Egyptian prisons for political reasons . The speech ended with confirming the role of the law in protecting the rights of the detainees and their families and in activating the available legal machineries to support the call for their legal rights of compensation and other rights" . The center delivered an application form of measurement to the trainees to measure out their informational ability concerning the course's subject .

- The first lecture began with the presentation of a working paper entitled “Commenting on the Emergency Law” - lectured by Mr. Saeed Mahmoud Al-Deeb and addressed in its topics:
1- Historical rooting for the declaration of the state of emergency in Egypt.
2- The reasons for declaring a state of emergency in accordance with the current Law 162 of 1958
3- The constitutional and legal guarantees for declaring a state of emergency.
4- Procedures vested in the executive authority in the emergency law.
5- The rights and guarantees of the detainee in the emergency law.
6- Judicial principles regarding detention.
The second lecture included: The topic of “Legal Procedures for Detainees” and a lecture by Professor Essam Abdel Aziz, and it dealt with the topics of the second paper:
1- Grievance against the arrest warrant
2- Visiting permit procedures and forms.
3- Laws governing the transmission of the notary.
4- Issuance of the arrest certificate.
- The first day ended with an open meeting that dealt with a public debate of the trainees raised by the issues raised through the submitted working papers about the legitimacy of the continuation of emergency laws despite the lack of justification for them because they constitute a flagrant violation of international conventions, the constitution and laws, which provoked the trainees through the meeting Open.

The second day's activities started at ten in the morning
The first lecture began with the presentation of a working paper entitled “Egyptian Prisons Law between Theoretical Reality and Practical Application” in which Professor Muhammad Abdullah Khalil lectured, and the paper dealt with:
1- An overview of the Prisons Organization Law No. 396 of 1956
2- Types of prisons in Egypt.
3- Rights of prisoners and detainees.
4- Egyptian Prisons Law between theoretical reality and practical application.
The second lecture dealt with a working paper entitled “Legal Protection Cases for Detainees before the Administrative Court,” in which Mr. Saeed Muhammad Al-Deeb lectured and dealt with topics:
1- Lawsuits for enabling education
2- A lawsuit to appeal the decision to prevent the visit
3- A lawsuit to appeal the administrative authority’s decision to refrain from counseling in the place of detention.
4- The appeal against the completion of the lawyer’s visit to the detainee or prisoner from behind separate wires.
5- A lawsuit to obtain a pension for the children of the detainee.
The third lecture: It included a working paper on “The Crime of Torture in Egyptian Legislation” and lectured by Mr. Saeed Mahmoud El-Deeb, and its topics were covered:
1- Constitutional texts criminalizing torture.
2- Legal texts:
A- The provisions of the Penal Code, Article 126 Penalties and Article 129 Penalties, which dealt with the criminalization of the act of torture and articles related to the crime of torture, in Articles 280 and 282 penalties.
B- Associated provisions of the Criminal Procedure Law
3- The Convention Against Torture
- Open meeting: The activities of the second day of the training course ended with an open meeting that dealt with a public dialogue between the trainees and trainers about the problem of the democratic state, the reality of the situation with the emergency law, the effects resulting from it and its impact on delaying the reform process, the spread of the phenomenon of arrests, and the increase in cases of torture that were monitored by civil society institutions until the case Whoever forces the authority to confront the rights guaranteed by the constitution and international covenants.
the third day
The third day activities started at ten in the morning.
The first lecture dealt with: a working paper entitled “Implementation of judgments issued by the administrative judiciary in Egyptian law.” The lecture was given by Mr. Essam Abdel Aziz, and its topics were addressed:
1- Implementation of judgments issued by the administrative judiciary.
2- The effect of the challenge on the enforcement of a ruling stopping execution.
3- The relationship of the judgment to stay of execution with the judgment in the original lawsuit.
4- The effect of the ruling to suspend execution on the ruling of annulment.
5- The effect of the annulment ruling on the ruling to suspend execution.
- The second lecture began: This lecture dealt with presenting a working paper entitled “Arrest Compensation Claims” - and Mr. Saeed Mahmoud Al Deeb lectured on its topics:
1- Cases of compensation for arrest.
2- Compensation for torture.
3- Compensation for the father, mother and wife for the period of detention of their relatives.
4- Compensation for non-implementation.
- The third lecture: included “practical training” to assess the understanding of the trainees on the lectures given to them over the course of three days.
- The center distributed an evaluation form for the training course in which the trainees assessed the experience of the course, including its positive and negative aspects.
The activities of the training course were concluded with a ceremony in which the director of the center distributed certificates of experience to the trainees who expressed their willingness to repeat the experience again in different topics.
